Terms of Service

1. Acceptance of Terms

By creating an account on itemzz.io, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.

These terms form a binding agreement between you and itemsnest GmbH, Berlin, Germany (VAT: DE348793078).

The service is offered to consumers in the European Union and European Economic Area. If you access the service from elsewhere, you do so on your own initiative and remain responsible for compliance with local law.

2. Description of Service

itemzz.io is a household board for consumers — one place for money, people, documents, and household preparedness. The service is provided as software-as-a-service (SaaS) via web browser.

Five operating modes (e.g. enrich, operate, report, legacy, crisis) are part of the same subscription, not separate products.

You may use the service to:

• Capture and organise household inventory, spaces, contracts, and documents
• Manage household members, contacts, and shared access (within plan limits)
• Track finances and generate household reports
• Use AI-assisted capture and suggestions (you remain responsible for decisions)
• Access crisis and preparedness tools where available (informational only — not emergency dispatch)

Some features depend on your location (e.g. German civil-protection warning feeds via NINA · MoWaS) and may not be available in all countries.

3. Account Registration and Access

Registration creates an account only. You must subscribe to use the product. There is no permanent free tier.

You must provide accurate information when registering. You are responsible for keeping your credentials secure. Notify us immediately at hello@itemzz.io if you suspect unauthorised access.

One person may not create multiple accounts to circumvent limits or refunds. We may terminate duplicate or abusive accounts.

4. Acceptable Use

You may use itemzz.io for lawful personal and household management only. You may not:

• Use the service for commercial resale or sublicensing without our written consent
• Attempt to gain unauthorised access to other users' data
• Upload illegal, harmful, or infringing content
• Use automated tools to scrape or extract data at scale
• Reverse engineer or attempt to extract the source code

5. Your Data and Privacy

You retain ownership of your data. You grant itemsnest GmbH a limited licence to store and process it solely to provide the service.

We do not sell your data. See our Privacy Policy.

You can export your data (Account Settings → Your Data) and delete your account (Account Settings → Danger Zone) at any time.

6. Subscription and Billing

Single subscription. We offer one household plan (monthly or annual billing). Prices and included features are published on itemzz.io/pricing.

Payment. Checkout is processed by Stripe Payments Europe, Ltd. (hosted checkout or Stripe Payment Links). By paying, you authorise recurring charges until you cancel. Prices include applicable VAT for EU consumers where required.

14-day money-back guarantee: If you are not satisfied with your first subscription payment, you must request a refund by email to refund@itemzz.io within 14 days of that payment. Use the email address on your itemzz account and state that you are requesting the money-back guarantee. Refunds are not available through the Stripe billing portal or in-app settings — email only. We process eligible requests and refund the first payment in full via your original payment method. This is voluntary and separate from (and does not replace) your statutory EU withdrawal rights — see our Widerrufsbelehrung.

Cancellation. Cancel anytime via account settings or the Stripe customer portal (cancellation only, not money-back refunds). Access continues until the end of the paid period. No refunds for partial periods except after an approved email request under the money-back guarantee or where required by law.

Price changes. We notify you at least 30 days before increases. Continued use after the effective date constitutes acceptance.

7. AI and Third-Party Information

AI features suggest extractions and actions from content you provide. They can be wrong. You must verify important information (tax, insurance, legal, medical, safety).

Warning feeds and external data (e.g. civil protection) are informational. They are not a substitute for official alerts, emergency services, or professional advice.

8. Service Availability

We aim for reliable uptime but do not guarantee uninterrupted service. Maintenance may occur with or without notice.

9. Termination

You may delete your account at any time.

We may suspend or terminate access for breach of these terms, fraud, or legal requirement, with notice where reasonably possible.

After termination, personal data is deleted within 30 days except where law requires retention (e.g. payment records — HGB §257).

10. Limitation of Liability

To the maximum extent permitted by law, itemsnest GmbH is not liable for:

• Loss of data (use export regularly)
• Indirect or consequential damages
• Outages of third-party providers (Supabase, Stripe, etc.)
• Reliance on AI output, warning feeds, or generated reports

Our total liability in any 12-month period is limited to the fees you paid in that period, or €100, whichever is greater.

Nothing limits liability for death or personal injury from negligence, fraud, or other mandatory liability under German law.

11. Intellectual Property

itemzz.io, its design, code, and branding are owned by itemsnest GmbH. You retain rights to your content.

12. Governing Law and Jurisdiction

German law applies. Courts of Berlin, Germany have jurisdiction for merchants.

If you are a consumer in another EU member state, you may bring proceedings in your country of residence.

13. Changes to These Terms

We notify you by email at least 14 days before material changes. Continued use after the effective date constitutes acceptance. You may delete your account if you disagree.
